TERMS AND CONDITIONS
Clients booking services with Joy Imaging agree to the following terms and conditions without exception.
1. Copyright to all images, videos and otherwise is fully retained by Joy Imaging, unless otherwise stated in writing. Any transfer of copyright must be requested and approved in writing. This includes any requests for sub-licensing/publication/commercial use of images; including by use of builders, architects, designers, stylists, etc. Extra costs will be incurred for approved commercial use of photography.
2. Real Estate photography and video provided to the original listing agent must only be used for marketing of the property, unless otherwise stated in writing. Clients must not provide copies of images to third parties, outside of the initial marketing campaign, except for vendors of property.
3. Property Owners and Agents retain no commerical rights to photographs. Copyright is limited to personal use and images may not be used outside of current marketing campaigns for commercial use of any kind. Transferral of photography to new listing agents at any point after the current marketing campaign is a breach of Australian copyright law.
4. For full commercial use of photography, a copyright release will be issued. Commercial use of photography will be in breach of copyright until copyright transfer is provided in writing.
5. Overdue fees apply to all invoices unpaid at the due date. Fees of 2% per day will be added to all unpaid invoices. Unpaid invoices are referred to Debt Collection after 30 days without further notice and all debt collection fees will be added to the invoice. Any Legal fees incurred will also be the responsibility of the debtor. Failure to pay by the due date may also result in take down requests direct to publishes such as listing websites and print advertisers without notification.
6. Joy Imaging makes every attempt to ensure the accuracy of media provided including floor plan, photography and video products. However no responsibility is taken for errors and omission or misstatement in media provided, including virtual and digitally enhanced products. It is understood and accepted that all final media provided by Joy Imaging has been digitally enhanced. Media is provided as a guide only for illustrative purposes. Clients are responsibly for checking all material for accuracy before publishing.
7. Floorplan measurements are provided as an guide only and are subject to estimation and rounding and should not be relied on for building and renovating purposes. Floor Plans are illustrative only. No responsibility is taken for errors and omission or misstatement
8. Joy Imaging and its representatives shall not be liable for any legal claim, action or damages resulting from the publication of any marketing material. It is the clients responsibility to check materials prior to publishing and to comply with all relevant legislation including advertising misrepresentation.
9. Joy Imaging retains the right to use any media provided in their own marketing in print and digital forms, unless specifically agreed in writing to the contrary.
